This could get interesting. The 5th Circuit Court of Appeals heard arguments the other day in a case in which two dudes got married in Massachusetts then tried to get divorced in Texas. The state court trial judge ruled the Texas law prohibiting gay marriage was unconstitutional and granted the divorce, so the Texas Attorney General appealed.
It would seem that gay marriage and gay divorce are sort of married to each other, and any particular state should adopt both or neither. We'll see what the 5th Circuit says on the issue. And the Texas Supreme Court could end up with the last word.
Any speculation on why they didn't go back to Massachusetts to get the divorce? Are quickie gay divorces available in Vegas? Could be that they are traveling activists trying to make new law in non-gay-marriage states.
Updated 9/1/10: See 5th Circuit -- no gay divorce in Texas.
