Mr. Menchaca has objected to something Mayor Mike Canon said. Here's Mr. Menchaca's statement found at PermianBasin360:
"it is my hope that the city council will honor the agreement voted and approved on June 26th city council meeting. i will wait to see the outcome in the next few days and hope they will be men and women of their word so that we can all move forward focused on the future and not the past. in the past several weeks, many people have wondered why i have not been able to sign the agreement but according to federal law under the age discrimination act i have to wait a minimum of 21 days before i'm able to sing. it is a priviledge afforded to the employee not the employer according to misspoken mike canon. there is also a recent letter that my attorney had sent to the city requesting clairification on the proposed separation agreement. the city attorney and mike canon have made statements that we were asking for more money and i am here to let you know and clear the air that that is an absolute lie that has been drawn up by city attorney keith stretcher and mike canon. and that he is misleading the public on the intentions that we had. we had never been asking for more money than what was negotiated by the council and approved by the council at the June 26th meeting." I've addressed the 21 day thing here with my belief that he's misreading the statute. He probably had the contract long before the City Council voted on it on June 26, and 21 days from his first look at it probably passed long ago. The 21 days is the statutory way of determining that a waiver of an age discrimination claim was voluntarily signed. And it's almost comforting to know that he wants to make sure that his alleged claim against the city was properly waived.
As for the "absolute lie," well, we could decide that for ourselves if only we could see the "clarification" letters Mr. Menchaca's lawyer sent to the city. Ms. Sparkman has been very good about posting the documents involved in this controversy, but so far, those letters aren't available at her website .
If Mr. Menchaca wants to help clear the air he could make those letters public.
UPDATE 7-22-07: Stephanie Sparkman has requested copies of the letters from Mr. Menchaca's attorney and will post them on her site when they become available.
