As pundits pore over Brett Kavanaugh's track record, so far the biggest complaint appears to be about a dissent he wrote in a case in which he may have laid the groundwork for Justice Robert's ruling that upheld the law. It would be hard for Democrats to use that as a reason to oppose him, but they certainly wouldn't mind if it troubled Republicans.
So once opponents begin scrutinizing the memos Kavanaugh wrote or approved while he worked for the G.W. Bush administration, one has to wonder whether any of them addressed waterboarding. Uh oh. Regardless of what the memos said, they would be turned into ammo for the opposition, for sure.
